Abstract
First paragraph: In Scotland, new legislation was introduced in March 2009 proposing significant changes to the nature and operation of community sanctions. Under provisions contained in the Criminal Justice and Licensing (Scotland) Bill most of the existing community sanctions - probation, community service, supervised attendance orders and community reparation orders - will be replaced by a generic order - the Community payback Order - to which a variety of specific requirements could be attached. Importantly, under the new legislation, judges will be offered the opportunity, where they consider it appropriate, to carry out periodic review hearings during the course of a Community Payback Order. In this respect, judges will become actively involved in the ongoing management of a community sentence.
